Failure to Yield Accidents

FAILURE TO YIELD ACCIDENTS

Failures to yield accidents are one of the most common types of car accidents in the state of Florida and anywhere else in the United States. As simple as these types of cases might seem, they are actually very complicated due to the fact that it could be unclear who is at fault. As unfair as it can be, it is common for the wrong person to be charged. Because of this, it is a good idea to consult an experienced accident attorney after a failure to yield accident.

The car accident lawyers at Madalon Law are determined to fight for the rights of the injured and their families. Our legal team understands the pain, anger, and frustration a person goes through after they are involved in a collision, which is why we offer a free consultation and will not bill a client for any of our legal services unless we win their case.

CAUSES OF FAILURE TO YIELD ACCIDENTS

While many of the leading causes of car accidents (Drunk driving, speeding, distracted driving, aggressive driving) can result in a failure to yield accident, a common theme is a driver not paying attention to the road, other vehicles and the law.

For a successful outcome, these cases need to be investigated thoroughly by an attorney that is familiar with this process. There is an underlying negligence that needs to be proven in these types of cases. Failure to do this can be the difference between receiving financial compensation for your medical bills, pain, suffering and lost wages – and receiving nothing.

Some of the most common failure-to-yield accidents include:

  • When a driver fails to yield at a crosswalk
  • When a driver fails to yield when making a left turn
  • When a driver fails to yield at a traffic signal
  • When a driver fails to yield to a bicyclist
  • When a driver fails to yield to a motorcycle
  • When a driver fails to yield when merging on or off a highway or other city road
  • When a driver fails to yield to an emergency vehicle
  • When a driver fails to yield to a pedestrian
  • When a driver fails to yield at a flashing traffic light
  • When a driver fails to yield in a parking lot
  • When a driver fails to yield in a private driveway

FAILURE TO YIELD CAR ACCIDENTS AND WHO IS AT FAULT

When an accident happens because someone failed to yield, it is common for the parties to argue over who was negligent. The wrong person could get the citation and this could spring the negligent driver into action and motivate them to seek an attorney. Once this happens, the attorney could then also accuse you of being negligent and seek financial compensation from you.

CONTACT A CAR ACCIDENT ATTORNEY

Because of this, you need to take pictures of the accident; damage and where the cars were positioned (do this before they are moved). You need to also get the names and contact information of all witnesses and remember not to admit fault or speak to the other driver’s insurance company. They may try to talk to you while you are confused about what just happened. Contact our Broward car accident attorneys today and we will go over your case with you.
