Incident 1: Disney Parks Actor Dies After Slip and Fall Accident During Stage Play:
A tragic incident occurred on August 6, 2009, during a performance of “Captain Jack’s Pirate Tutorial.” A 47-year-old cast member, Mark Priest, portraying a pirate slipped on a wet spot on the stage, striking his head on a nearby wall.
The employee was rushed to Florida Hospital in Orlando with critical injuries including a fractured neck vertebra and extensive head lacerations requiring 55 stitches. Sadly, he succumbed to his injuries four days later. Reports indicate that the actor was performing on a newly constructed stage and was performing a sword fight for the first time when he stepped on the puddle and slipped.
Incident 2: Disney World Guests Trips Over Sidewalk Caulking:
In a 2002 incident, a 43-year-old guest, Fatima Aguiar at Walt Disney World’s Magic Kingdom tripped on a loose piece of sidewalk caulking. As a result, the guest fell on all fours and hurt her knee. While she couldn’t definitively prove the caulking caused the fall, Disney’s own maintenance worker testified that such loose material was a known tripping hazard and was regularly removed.
The initial court ruling favored Disney, but this decision was overturned on appeal. The court determined that Disney should have anticipated the risk posed by the deteriorating caulking and was therefore liable for the guest’s injuries.
